Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the American Kids website and related services (the “Service”), operated by American Family Office LLC (“American Kids,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes the organization.
1. Eligibility; Authorized Use
Age. You must be at least 18 years old to use the Service. The Service is not intended for use by minors.
Authority to act. The Service is intended for adults submitting information for themselves or on behalf of minors. If you provide information about another person (including a child), you represent that you are legally authorized to do so and to request any submission or delivery of forms on their behalf.
U.S.-only. The Service is intended for use by individuals located in the United States. If you access the Service from outside the United States, you do so at your own initiative and are responsible for compliance with applicable laws.
2. The Service; Free and Paid Options
We provide tools and services to help users prepare forms and related documents, including forms associated with “Trump Accounts.”
Free option. We may make available a self-service option that allows you to enter information and generate documents for your own use and submission.
Paid option. We may offer paid services that can include review for completeness and consistency and, where applicable, assistance with submission or delivery of documents as instructed by you. Paid services do not guarantee acceptance by any government agency or third party and do not guarantee any particular result.
We may modify, suspend, or discontinue any part of the Service at any time.
3. No Legal, Tax, or Financial Advice; No Professional Relationship
The Service is provided for informational and convenience purposes. We are not a law firm or tax advisor and do not provide legal, tax, or financial advice. Use of the Service does not create an attorney-client, accountant-client, fiduciary, or other professional relationship. You are responsible for reviewing all forms and information for accuracy and completeness and for determining whether and how to submit them. You should consult a qualified professional for advice specific to your situation.
4. Your Responsibilities
You agree to:
- provide accurate, current, and complete information;
- use the Service only for lawful purposes;
- not misuse the Service, attempt unauthorized access, interfere with the Service, or bypass security controls;
- not submit information you are not authorized to submit; and
- comply with these Terms and applicable laws.
If the Service offers accounts or credentials, you are responsible for maintaining their confidentiality and for all activity under your account.
5. Payments; Refunds
Fees. If you purchase a paid service, you agree to pay all applicable fees disclosed at checkout. Fees are generally charged at the time of purchase.
Payment processing. Payments are processed by a third-party processor. We do not store full payment card details.
Refunds.
We want you to feel confident using American Kids. If you are not satisfied with a paid service for any reason, you may request a full refund, no questions asked, provided the request is made within 30 days of purchase. To request a refund, contact us at support@americankids.org with your order details. Approved refunds will be issued to the original payment method.
6. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated by reference.
7. Third-Party Services; Third-Party Recipients
Third-party providers. The Service may rely on third-party services (for example, infrastructure providers, payment processors, communications providers, and analytics tools). We do not control third-party services and are not responsible for their acts or omissions.
Third-party recipients you designate. If you instruct us to submit or deliver forms or documents to a third party (including a government agency), you authorize us to disclose the information contained in those forms as necessary to carry out your request. Once transmitted, the information will be subject to the recipient’s policies and practices, and we are not responsible for the recipient’s handling of the information.
Links. Any third-party links are provided for convenience only and do not constitute endorsement.
8. Intellectual Property
We and our licensors retain all rights, title, and interest in the Service, including software, design, text, and trademarks. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any forms or outputs will be accepted by any third party.
10. Limitation of Liability
To the maximum extent permitted by law:
We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to the Service or these Terms.
Our total liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim or (b) $500.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless American Family Office LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party, including through information you submit or direct us to submit.
12. Termination
We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or if necessary to protect the Service, users, or third parties. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (including Sections 8–13).
13. Governing Law; Venue
These Terms and any dispute arising out of or related to the Service are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Except where prohibited by law, you agree that any action must be brought in the state or federal courts located in Wyoming, and you consent to jurisdiction and venue in those courts.
14. Changes to These Terms
We may update these Terms from time to time. Updates will be posted with an updated “Last Updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
